Vonkerz terms and condition

YOU MAY NOT ACCESS OR IN ANY WAY MAKE USE OF VONKERZ.COM UNLESS YOU ARE AT LEAST 18 YEARS OLD.

Vonkerz.com is a social networking service that allows Members to create unique personal profiles online in order to find and communicate with old and new friends. By using the vonkerz.com web site you agree to be bound by these Terms of Service (this "Agreement"). If you wish to become a Member and communicate with other Members and make use of the Vonkerz.com. service (the "Service"), read these Terms of Service and indicate your acceptance of them by following the instructions in the Sign Up page.

This Agreement is for an indefinite term and you understand and agree that you are bound by such terms till the time you access this site.

VONKERZ.COM RESERVES THE RIGHT TO REMOVE ANY PERSON FOR ANY OR NO REASON FROM THE VONKERZ.COM NETWORK. YOU ACKNOWLEDGE AND AGREE THAT VONKERZ.COM SHALL STORE REMOVED INFORMATION. YOU ACKNOWLEDGE AND AGREE THAT VONKERZ.COM IS NOT LIABLE FOR ANY LOST OR INTENTIONALLY DELETED INFORMATION OR DATA.

Eligibility

You must be 18 or over to register as a member of vonkerz.com or use the Web site. Membership in the Service is void where prohibited. By using the Web site, you represent and warrant that you have the right, authority, and capacity to enter into this Agreement and to abide by all of the terms and conditions of this Agreement. Your use of the vonkerz.com Services does not violate any applicable law or regulation. Your profile may be deleted and your Membership may be terminated without warning, if we believe that you are less than 18 years of age.

Term

This Agreement will remain in full force and effect while you use the Web site and/or are a Member. vonkerz.com may terminate your membership for any reason, at any time. Even after membership is terminated, this Agreement will remain in effect.

Password.

When you sign up to become a Member, you will also be asked to choose a password. You are entirely responsible for maintaining the confidentiality of your password. You agree not to use the account or password of another Member at any time or to disclose your password to any third party. You agree to notify vonkerz.com immediately if you suspect any unauthorized use of your account or access to your password. You are solely responsible for any and all use of your account.

Changes

We reserve the right to add to or change/modify the terms of this Agreement including but not limited to suspend / cancel, or discontinue any or all channels, or service at any time without notice , make modifications and alterations in any or all of the content, products and services contained on the site without prior notice. You will be deemed to have accepted such change/s if you continue to access the site subsequent to such changes.

Fees.

You acknowledge that vonkerz.com reserves the right to charge for the vonkerz Services and to change its fees from time to time in its discretion. If vonkerz.com terminates your Membership because you have breached the Agreement, you shall not be entitled to the refund of any unused portion of subscription fees.

Non Commercial Use by Members

The Web site is for the personal use of individual Members only and may not be used in connection with any commercial endeavors. Organizations, companies, and/or businesses may not become Members and should not use the Service or the Web site for any purpose. Illegal and/or unauthorized uses of the Web site, including collecting email addresses of members by electronic or other means for the purpose of sending unsolicited email and unauthorized framing of or linking to the Web site will be investigated, and appropriate legal action will be taken, including without limitation, civil, criminal, and injunctive redress.

Content Posted on the Site

You understand and agree that vonkerz.com may review and delete any content, photos or profiles (collectively "Content") that in the sole judgment of vonkerz.com violate this Agreement of which might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of Members.

Your profile must describe you, an individual person. Examples of inappropriate profiles include, but are not limited to, profiles that purport to represent an animal, place, inanimate objects, fictional character, or real individual who is not you. You are solely responsible for the Content that you publish or display (hereinafter, "post") on the Service, or transmit to other Members.

By posting Content to any public area of vonkerz.com, you automatically grant, and you represent and warrant that you have the right to grant, to vonkerz.com an irrevocable, perpetual, non-exclusive, fully paid, worldwide license to use, copy, perform, display, and distribute such information and content and to prepare derivative works of, or incorporate into other works, such information and content, and to grant and authorize sublicenses of the foregoing.

Vonkerz.com reserves the right to investigate and take appropriate legal action in its sole discretion against anyone who violates this provision, including without limitation, removing the offending communication from the Service and terminating the membership of such violators. Even though such use is strictly prohibited, there is a small chance that you might become exposed to such items and you further waive your right to any damages (from any party) related to such exposure.

You must use the Service in a manner consistent with any and all applicable laws and regulations.

You may not engage in advertising to, or solicitation of, other Members to buy or sell any products or services through the Service.

You may not transmit any chain letters or junk email to other members. Although vonkerz.com cannot monitor the conduct of its members off the Web site, it is also a violation of these rules to use any information obtained from the Service in order to harass, abuse, or harm another person, or in order to advertise to, solicit, or sell to any member with their prior consent.

Copyright Policy

You may not post, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior written consent of the owner of such proprietary rights. Without limiting the foregoing, if you believe that your work has been copied and posted on the Service in a way that constitutes copyright infringement, please provide us with the following information: an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest; a description of the copyrighted work that you claim has been infringed; a description of where the material that you claim is infringing is located on the Web site; your address, telephone number, and email address; a written statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf. .MEMBER CONDUCT

You as a responsible adult (18 years or above) shall be solely responsible for all content that you upload post or otherwise transmit .You acknowledge and agree that all information, data, text, software, music, sound, photographs, graphics, artwork, video, messages or other materials ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from which such Content originated. You acknowledge and agree that vonkerz.com is not responsible for all Content that you upload, post, email, transmit or otherwise make available via the vonkerz.com. You acknowledge and agree that vonkerz.com does not control the Content posted via the Service and, as such, does not control the accuracy, integrity, quality or any aspect of such Content. You understand that by using the Service, you may be exposed to Content that is offensive, indecent or objectionable. You acknowledge and agree that under no circumstances is vonkerz.com liable in any way for any Content, including, but not limited to, for any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Service.

Indian Law

The Agreement shall be governed by the Laws of India. The Courts of law at Delhi, India shall have exclusive jurisdiction over any disputes arising under this agreement.

Proprietary Rights in Content

All proprietary rights in the Website and the Service of the vonkerz.com are owned by vonkerz.com. 

Member Disputes.

While vonkerz.com has the right to monitor content, including disputes between you and other members, it is not obligated to interfere. You, the user or member is solely responsible for your own conduct and interactions with other vonkerz.com members.

MODIFICATIONS TO SERVICE

Vonkerz.com reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that Vonkerz.com is not liable to you or to any third party for any modification, suspension or discontinuance of the Service.

LINKS

The Service may provide, or third parties may provide, links to other World Wide Web sites or resources. Because Vonkerz.com has no control over such sites and resources, you acknowledge and agree that Vonkerz.com is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any Content, advertising, products, or other materials on or available from such sites or resources. You further acknowledge and agree that Vonkerz.com shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such site or resource.

Other.

By becoming a Member of the Site / vonkerz.com Service, you agree to receive certain specific emails from vonkerz.com.

You are under an obligation to report any misuse or abuse of the Site. If you notice any abuse or misuse of the Site or any thing which is in violation of this Agreement, you shall forthwith report such violation to report@vonkerz.com. On receipt of such complaint, vonkerz.com may investigate such complaint and if necessary may terminate the membership of the Member responsible for such violation abuse or misuse without any refund of subscription fee. Any false complaint made by a Member shall make such Member liable for termination of his / her membership without any refund of the subscription fee.

vonkerz.com reserves the right, in its sole discretion, to reject, refuse to post or remove any posting (including private messages) by you, or to restrict, suspend, or terminate your access to all or any part of the vonkerz.com Services at any time, for any or no reason, with or without prior notice, and without liability.

Disclaimers.

Vonkerz.com is not responsible for any incorrect or inaccurate Content posted on the Site or in connection with the Vonkerz.com Service, whether caused by users visiting the Site, Members or by any of the equipment or programming associated with or utilized in the Service, nor for the conduct of any user and/or Member of the Vonkerz.com Service whether online or offline. Vonkerz.com assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, user and/or Member communications. Vonkerz.com is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to users and/or Members or to any other person's computer related to or resulting from participating or downloading materials in connection with the Vonkerz.com Site and/or in connection with the Vonkerz.com Service. Under no circumstances will Vonkerz.com be responsible for any loss or damage to any person resulting from anyone's use of the Site or the Service and/or any Content posted on the Vonkerz.com Site or transmitted to Vonkerz.com Members. The exchange of profile(s) through or by Vonkerz.com should not in any way be construed as any offer and/or recommendation from/by Vonkerz.com. Vonkerz.com shall not be responsible for any loss or damage to any individual arising out of, or subsequent to, relations established pursuant to the use of Vonkerz.com. The Site and the Service are provided "AS-IS AVALIABLE BASIS" and Vonkerz.com expressly disclaims any warranty of fitness for a particular purpose or non-infringement. Vonkerz.com cannot guarantee and does not promise any specific results from use of the Site and/or the Vonkerzbox.com Service.

Limitation on Liability.

Except in jurisdictions where such provisions are restricted, in no event will Vonkerz.com be liable to you or any third person for any indirect, consequential, exemplary, incidental, special or punitive damages, including also lost profits arising from your use of the Site or the Vonkerz.com Service, even if Vonkerz.com has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, Vonkerz.com, liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to Vonkerz.com, for the Service during the term of membership.

Disputes.

If there is any dispute about or involving the Site and/or the Service, by using the Site, you agree that the dispute will be governed by the laws of India. You agree to the exclusive jurisdiction to the courts of Delhi, India.

Indemnity.

You agree to indemnify and hold Vonkerz.com, its subsidiaries, directors, affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorney's fees, made by any third party due to or arising out of your use of the Service in violation of this Agreement and/or arising from a breach of these Terms of Use and/or any breach of your representations and warranties set forth above and/or if any Content that you post on the Vonkerz.com Website or through the Vonkerz.com Services causes Vonkerz.com to be liable to another.
